Terms of Use

These Terms of Use ('Terms') govern your access to and use of the Perk App, operated by 1st-flame UG (haftungsbeschränkt), Schnellerstraße 60, 12439 Berlin ('we,' 'us,' or 'Perk'). By registering, accessing, or using the Perk App, you agree to these Terms, our Privacy Policy, and any applicable terms imposed by Apple Inc. under the Apple Standard End User License Agreement (EULA). If you do not accept these Terms, you must refrain from using the App.

Service Overview

The Perk App is a digital platform for individuals aged 18 and older to connect, make friends, or explore dating. Users may purchase virtual credits ('Credits') or auto-renewable subscriptions ('Subscriptions') to access enhanced features and benefits.

Eligibility and Registration

• You are at least 18 years old and legally capable of entering into a binding agreement.
• You warrant that your registration information is accurate and will keep it updated.
• You agree to maintain the confidentiality of your credentials and are responsible for all activity on your account.
• Only one account per user is allowed. Multiple accounts or false registration are prohibited.
• Perk may refuse, suspend, or terminate any account for breach of these Terms or applicable law.

Subscriptions and Auto-Renewal

• Perk offers auto-renewable subscription plans that provide additional functionality and benefits within the App.
• The title, duration, and price of each subscription are displayed clearly within the App before purchase.
• Payment will be charged to your Apple ID account upon confirmation of purchase.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period, at the same price and duration as the original plan unless otherwise stated.
• You can manage or cancel your subscription at any time through your Apple ID account settings on your device after purchase.
• Refunds for subscription payments are handled exclusively by Apple in accordance with their policies.
• Deleting the App does not automatically cancel your subscription.

Profile Visibility, Location, and Dating Mode

By enabling discovery features, you agree to share your profile and location with other users as per your preferences. You may enable or disable 'Dating Mode' at any time. When off, your profile and location remain hidden.

Credits, Digital Gifts, and Invitations

• Credits are virtual items and have no cash value.
• Credits may only be used to attach digital gifts to invitations.
• When an invitation is sent, Credits are deducted from the sender’s balance.
• If the invitation is accepted, the same number of Credits is credited to the recipient.
• Credits are non-refundable, non-transferable, and cannot be exchanged for cash.
• A user may invite the same person only once within a defined period.

Credit Redemption and Fees

• Credits may be redeemed at authorized Perk partner venues or for eligible gift cards.
• Perk deducts a 30% fee on all redemptions; 70% applies toward the reward.
• Redemptions may require identity verification and are final and non-reversible.

User Conduct and Acceptable Use

• The App is for personal, non-commercial use only.
• Do not impersonate others or post unlawful, abusive, or inappropriate content.
• Harassment, solicitation, spamming, or unauthorized data collection is prohibited.
• Perk may remove content or suspend accounts at its discretion.

User Content and Intellectual Property

You retain ownership of content you submit but grant Perk a worldwide, royalty-free license to use it for operation and promotion of the App. All intellectual property rights remain with Perk or its licensors.

Privacy

Your personal data is processed under our Privacy Policy. By using the App, you consent to the collection and processing of your data as described.

Account Termination and Suspension

• You may terminate your account anytime via the App.
• Perk may suspend or terminate accounts for violations, without prior notice.
• Remaining Credits are forfeited upon termination, unless required otherwise by law.
• Canceling your subscription through Apple does not automatically delete your Perk account.

Limitation of Liability

To the extent permitted by law, Perk is not liable for indirect, incidental, or consequential damages arising from use of the App. Aggregate liability is capped at €100 or the amount you paid in the last 12 months, whichever is greater.

Indemnification

You agree to indemnify and hold harmless Perk, its affiliates, officers, employees, and agents from any claims or liabilities arising from your use of the App, your content, or violation of these Terms or third-party rights.

Changes to Terms

Perk may update these Terms at any time. Updates take effect upon publication in the App or on our website. Continued use of the App after updates constitutes acceptance of the revised Terms.

Governing Law and Jurisdiction

These Terms are governed by German law. Disputes are subject to the exclusive jurisdiction of the courts of Berlin, Germany.
