Terms of Service

1. Who we are and agreement

Perk is operated by 1st-flame UG (haftungsbeschränkt), Schnellerstraße 60, 12439 Berlin, Germany ("Perk", "we", "us"). These Terms, the Privacy Policy, Cookie Policy and Community Guidelines form the agreement between you and Perk.

By creating an account or using Perk, you agree to this agreement. If you use Perk for an organisation, you confirm that you may bind it. App-store terms also apply to downloads and in-app purchases made there; those store terms control only where they conflict with these Terms.

2. Eligibility and accounts

You must be at least 16 years old and legally able to use Perk. If you are under 18, you confirm that you have any permission required by applicable law. Perk is not directed to children under 16. You must provide accurate information, keep credentials and devices secure, and notify us promptly of unauthorised access.

You may not create accounts through bots, impersonate another person or organisation, evade an enforcement action, sell an account, or use credentials that do not belong to you. You are responsible for activity you authorise.

3. The Perk service

Perk may provide AI companions and agents, AI chat and voice, tutoring, document and presentation tools, file storage and previews, social profiles and feeds, posts, photos and videos, messaging, calls, discovery, calendar and job tools, browser-assisted features, experiences, reservations, credits, gifts and partner redemptions. Availability varies by device, country, account and release.

Features may be added, changed, limited or discontinued. We will give reasonable notice where a change materially harms an ongoing paid service, unless an urgent security, safety or legal reason prevents notice.

4. AI features and generated output

AI output may be inaccurate, incomplete, outdated, offensive or unsuitable. It is generated by machines and is not a statement by a human. Do not rely on it as medical, legal, financial, employment, emergency or other professional advice; verify important information and use qualified professionals.

You are responsible for your prompts, uploaded material, instructions, decisions and use of output. Do not use AI features to make unlawful high-impact decisions about another person, deceive people about synthetic content, create non-consensual intimate content, exploit minors, bypass safeguards, or develop malware or other harmful activity.

Perk may use third-party AI providers to process prompts, files, voice input and relevant conversation context to provide a requested feature. The Privacy Policy explains this processing. We do not promise that output is unique or that it can be protected by intellectual-property law.

5. Social, messaging and communication features

You control what you publish and, where offered, its audience. Recipients may copy, capture or reshare content, so do not share information you cannot safely disclose. Calls and messages depend on network and recipient availability and are not emergency services.

Some private-message features may use end-to-end encryption where explicitly shown. That label does not apply to every Perk feature, metadata, backups, reports, AI conversations or content you intentionally share with an AI feature. Never assume encryption unless the product says so for that conversation.

Feeds and suggestions may be ranked using signals such as recency, your follows, interactions, language, interests, safety signals and content popularity. Where controls exist, you can change audience, mute, block, report, unfollow or choose another feed option.

6. Your content and licence

You retain ownership of content you submit. You grant Perk a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for technical formatting, transmit and display that content only as needed to operate, secure, improve and promote the Service according to your settings. The licence ends when the content is deleted, except for lawful retention, backups, content shared with others that they retain, and material used with your separate permission.

You confirm that you have the rights and permissions needed for your content, including the consent of people depicted or recorded. Feedback may be used without restriction or payment, but we will not publicly attribute it to you without permission.

7. Acceptable use and moderation

You must follow the Community Guidelines. Prohibited conduct includes illegal activity; threats, harassment and hate; sexual exploitation; fraud, spam and manipulation; dangerous goods; malicious code; scraping or automated access without written permission; interfering with security; collecting personal data unlawfully; and infringement of privacy or intellectual-property rights.

We may use automated systems and human review to detect, rank, restrict, label or remove content and to limit accounts. Enforcement will be proportionate to severity, context, history and risk. Where required, we will provide reasons and an internal appeal route. You may report illegal content or guideline violations through in-product reporting or by emailing us.

8. Third-party services and content

Perk may connect to or embed services such as identity providers, app stores, maps, video, payments, hosting, AI models and public websites. Their terms and privacy practices apply to their services. Links and generated summaries are not endorsements, and Perk does not control third-party availability or content.

9. Payments, subscriptions, credits and reservations

Price, taxes, billing period, renewal terms and material restrictions are shown before purchase. Subscriptions renew only as disclosed at checkout and can be cancelled through the purchasing platform or the stated account controls. Deleting Perk does not automatically cancel an app-store subscription. Statutory cancellation and refund rights are not limited.

Credits, gifts and other virtual items are licensed, not sold; have no cash value; cannot be transferred outside supported features; and may expire only if disclosed before acquisition. We may correct balances affected by error, fraud or reversal. Partner venues, merchants and experience providers—not Perk—are responsible for the goods and services they provide unless Perk is identified as the seller.

Payment processors receive payment details directly where possible. Perk may receive transaction status, amount, currency and limited billing identifiers. Additional vendor terms apply to business partners.

10. Intellectual property

Perk's software, design, branding and service content are protected by law. We grant you a limited, personal, non-exclusive, non-transferable and revocable right to use the Service under these Terms. You may not copy, sell, reverse engineer, circumvent access controls or create derivative services except where law expressly permits it.

Send copyright or trademark notices to [email protected] with your contact details, the protected work, the reported material and location, your good-faith statement and a signature. We may forward the notice to the affected user.

11. Suspension, deletion and termination

You may stop using Perk and request account deletion in the app where available or by contacting us. We may restrict or terminate access for a material breach, legal requirement, security threat, harm to others, prolonged inactivity or discontinuation of the Service.

Except for urgent or severe cases, we will ordinarily give notice and an opportunity to cure or appeal. Sections that by their nature should survive—such as ownership, payment obligations, disclaimers and dispute terms—remain effective after termination.

12. Disclaimers and liability

Perk is provided with reasonable care and skill, but we do not guarantee uninterrupted availability, error-free AI output, a particular match, job, reward, reservation or commercial result. Nothing excludes warranties or rights that cannot legally be excluded.

Perk is liable without limitation for intent, gross negligence, injury to life, body or health, fraud, guarantees and mandatory product liability. For slight negligence, Perk is liable only for breach of an essential contractual duty and only for foreseeable typical damage. These limits do not affect mandatory consumer law.

13. Changes to these Terms

We may update these Terms for new features, legal or regulatory changes, security, abuse prevention or clearer drafting. We will identify the effective date and give reasonable advance notice of material changes. If a change requires consent, we will ask for it. Continued use does not waive rights that require express consent.

14. Governing law and disputes

German law applies, excluding conflict-of-law rules, while consumers retain mandatory protections of their country of residence. Statutory venues apply; an exclusive Berlin venue applies only where legally permitted, such as for merchants. The European Commission discontinued its Online Dispute Resolution platform in 2025; we are not obliged or willing to participate in a consumer arbitration board unless required by law.
